Abstract
“Free Culture” is an important concept in the copyright legal system in the Taiwanese music industry. Nowadays, there is an imbalance when it comes to copyright interest distribution between copyright collective societies and creators in the Taiwanese music market. In the Taiwanese music market, the music copyright collective societies hold a major part of copyright interest and most of the licensing profit. These problems result in the decreased incentive to be creative. The function of encouraging creativity in copyright law is depressed. Music creator’s artistic freedom is restricted by the current copyright system and copyright collective societies in the Taiwanese music industry. Under solid music licensing system, it is believed that the Taiwanese music collective management organizations will creat essential benefits and supports for musicical artists. Additionally, collective management organization will also establish a successful music platform between creators and users .To release this copyright from music copyright collective management organizations, this research aims to construct a proper standard in copyright legal system and collective management regulation in Asian.
