Abstract
Since the patented technology licensing is more and more common in high-tech industry nowadays, how to avoid patent misuse (patent abuse) from the patent owners and keep all companies in the industry continuing making progress or improvements by keeping innovation and not being disturbed from patent misuse is an issue worthing discussion. This thesis takes existing executed license agreements as examples to discuss the related questions, and also takes Fair Trade Law related cases happened in Taiwan as instances as well as related foreigne rules and regulations to figure out what would apply to the said agreements.
