Abstract
First, this paper deals with the impact of copyright law when it gets into the Internet world and clarify the legal issues of the safe harbor rules in DMCA by examining the practical cases. Also, this paper discusses what difficulties can not be resolved in the digital times by using safe harbor rules. Besides, by examining Recent legislation of online copyright infringement and practical cases on the Internet like America、the United Kingdom、South Korea and Italy, it concludes that new legislation is tendency to achieve the goal of protecting copyright on the Internet by blocking websites or increasing the ISPs’ obligation to monitor the online infringing content . After examining the foreign comparative copyright law, the paper look back to the current safe harbor rules in Taiwan Copyright Law and proposes some comments about the latest policy which Intellectual Property Offices proposes to protect the online copyright. Last but not the least, this paper reviews the appropriateness of regulations about blocking the websites to protect the online copyright and put forward some proposals on ISP safe harbor rules to balance different interests of copyright owners, ISPs, and their users.
