Abstract
The service that based on Mobile Internet, which is the combination of wireless communication and Internet, now is deem as the industry which has the highest potential for growth, because of the development and market growth of smart phone and wireless communication network. Location Based Service (LBS): real-time record user’s location and using it to sending user information to the user's mobile phone or providing service, let it becomes the new start of the emerging e-commerce. On the customers’ aspect, LBS could make our life more convenient. For example, Global Positioning System (GPS), Google Map already became a part of most of people’s daily life. Also, on the aspect of enterprise, LBS could make the advertisement be more efficient. However, when the service is providing, the location data of the user would pass thought the telecommunication service providers, the application provider, the operation system provider and many others service providers who might even didn’t have any agreement with the user. If those data are processed, it could easily describe the user’s electronic footprints, like his/her hobbies, interest, neighbor and even what is he/she thinking, and that is the risk of location data: the possibility of personal privacy assaulting. Especially, location data could link a physical person with the person who has some kind of hobbies, interest or thought online, and it just makes the risk of personal privacy get higher. In 2012, new amended "Personal Information Protection Act" came into force, which greatly expanded the new regulation to all industries, however, when the enterprises are complaining about how hard to comply with it, the performance of this Act still be questioned. Moreover, about location data, there is a long-term ignorance of it, and even the new amendment still is. Considering about the risk that LBS and location data might arise, most of the countries start to face it and deal with it, but if the new amendment is enough to protect personal information in this diverse technology applications booming era is the motivation of this study. Because the regulation of European Unit and European countries is always the important reference of the regulation of personal information protection in Taiwan, so this study will try to compare the regulation between Taiwan and European Unit and some European countries, and try to find some inspiration for the future development about personal information protection regulation in Taiwan.
