Abstract
The challenge of 21□ century’s Knowledge Economy has brought forth more and more concerns towards the globalization of intellectual property rights (hereafter “IPRs”). Lain in today’s framework of market economy, we can never ignore the effect caused by the privatization of Western IPRs and its promotion function for cultural developments and technological innovation. Nor can we decline Eastern societies’ inferior positions resulting from their vacuum of an intellectual property scheme. The core of this problem has exactly lain in the interacted consequence between the IPR system and the market economy. As a matter of fact, this effect has existed on the basis of comparative advantages in traditional industries of Western and Eastern countries for a long time. Meanwhile, the reason why IPRs has been put particular emphasis under the framework of GATT and WTO is due to the reflection of Anglo-Saxon countries’ serious concern towards Mercantilism and Material Civilization. Therefore, this paper tries to start from the developing traces of TRIPs. This author will expound upon its main issues and backgrounds during significant phases and conclude by the evolution of international regulatory framework of IPRs’. I will also try to refine many corresponding values arising from this evolution process.
