Abstract
Accelerating the establishment of new technology-based industries has long been government’s policy. Meanshile joint endeavors in undertaking Research and Development projects have become essential to most major R & D plans, including basic scientific research, national R & D plans and industrial R & D. This has particularly been the case since Taiwan became a member of the World Trade Organization. The harmonization between policy with regard to technological development/ and the wellbeing of national competition/, benefits derived from fair competition and the maintenance of the mechanisms market competition all share the same antitrust concerns, viz. possible collusion. According to the Fair Trade Law of Taiwan, joint R & D projects among competitors have generally been prohibited unless they have received prior approval from the Fair Trade Commission. It has, therefore, become necessary to identify the way to find a balance between the goals of national development and the welfare of competition policy. This is, indeed, the core issue covered in this/ research.
